1. Scope and provider
(1) These terms apply to all contracts about using JustSee and buying credits between ONCHAIN GAME RESEARCH LTD, Makedonias 5, Sunrise Complex, House 12, 7080 Pyla, Larnaca, Cyprus, registration number HE 445597 (“JustSee”, “we”), and you.
(2) JustSee is offered to businesses, freelancers and consumers. A consumer is any natural person who concludes a contract mainly for purposes outside their trade, business or profession.
(3) Customer terms that deviate from these terms only apply if we expressly agree to them in text form.
2. Services
(1) JustSee is software in which AI agents in a 3D city create marketing content for your website, for example Instagram carousels, blog articles and videos. On accounts you connect yourself we only publish after your approval or in an automatic mode you switch on.
(2) Free of charge are, in particular, moving through the 3D world, the website scan with notes and clearly labelled examples, and a limited number of short AI replies per day. Paid work uses credits.
(3) JustSee is in an open beta. Features can change. Not every platform or workflow shown is available yet. What counts is what is shown to you before you start paid work.
(4) AI results are created automatically. They can be factually wrong, incomplete or unsuitable for your purpose. We do not owe any specific reach, revenue or business success.
3. Account
(1) Paid features need an account. You sign in with an email code or a recovery key. Only adults may make purchases.
(2) Keep your access details secret. Tell us immediately if you suspect misuse.
4. Conclusion of contract
(1) Showing the credit packages is not yet a binding offer.
(2) You choose a package, confirm these terms and the immediate start of performance, and are forwarded to our payment provider Stripe. There you see the package and the total price and can check and correct your input. By clicking the payment button you make a binding offer.
(3) The contract is concluded when the payment is confirmed and we add the credits to your account. You receive a confirmation or invoice by email.
(4) The contract languages are German and English. We store your purchases in your account. You can view, save and print these terms on this page at any time.
5. Prices and payment
(1) The prices shown during purchase apply. All prices are final prices in euros including statutory VAT. The total shown by Stripe before you confirm the payment governs.
(2) Payment is processed by Stripe with the payment methods offered there. It is due immediately.
(3) Each package is a one-time payment. There is no subscription and no automatic top-up. You can buy any package as often as you like.
6. Credits
(1) Credits are usage units for paid features in your JustSee account. They are not money, e-money or a means of payment. They cannot be transferred and are only refunded in the cases set out in these terms or by law.
(2) Before any paid work we show you the maximum number of credits. Work only starts when you confirm this limit. We charge the actual usage, at most the confirmed limit. Unused credits are released again.
(3) Only usable results are charged. If work fails our quality check or a technical error occurs, no credits are deducted for it.
(4) Paid credits do not expire. Free bonus or test credits are kept separately, have no cash value and can be time-limited.
7. Right of withdrawal
Consumers have a statutory right of withdrawal. Details are in the withdrawal notice. If you withdraw in time, we refund the price of unused credits. For credits already used you pay compensation for their value.
8. Your content and publishing
(1) Only enter websites, texts, images and data that you are allowed to use for this purpose.
(2) Check results before any use. You are responsible for content you publish or have published. This includes the rules of each platform and legal labelling duties, for example for advertising or AI-generated content.
(3) Not allowed: unlawful, misleading, offensive, discriminatory or infringing content, spam, bypassing technical limits and automated mass access without our permission.
(4) If there are concrete indications of a violation, we may stop individual work or suspend your account. We take your legitimate interests into account and inform you.
9. Rights to results
(1) The results belong to you. To the extent rights in them arise with us, we grant you an exclusive, transferable right of use unlimited in time and territory, including for commercial purposes and edits.
(2) AI results are not always protected by copyright. Similar results can arise independently for others.
(3) JustSee software, 3D world, characters and templates remain our property. You may use them within the service.
(4) We do not use your content to train our own AI models and do not pass it on to other customers.
10. Availability
We aim for high availability but do not owe a specific level during the beta. Maintenance and outages at third parties, for example AI providers, platforms or the payment service, can cause interruptions. Platforms can change their interfaces or restrict access.
11. Liability
(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under product liability law and to the extent of any guarantee we have given.
(2) For slight negligence we are only liable for breach of an essential contractual obligation whose fulfilment makes the proper performance of the contract possible in the first place and on which you may regularly rely. In that case liability is limited to the typical, foreseeable damage.
(3) Otherwise liability is excluded. These rules also apply to our staff and agents.
(4) Statutory warranty rights of consumers remain unaffected.
12. Term, termination, refunds
(1) The usage contract runs for an indefinite period. You can terminate it at any time and have your account deleted, for example by email to hello@justsee.ai.
(2) We can terminate with 30 days’ notice. The right to terminate for good cause remains unaffected.
(3) When the contract ends, we refund on request the price of unused paid credits, pro rata to the package price paid. This does not apply if we terminate for good cause because of your violation, to the extent this caused us damage.
13. Changes
We can change these terms for the future, for example because of new features or changes in the law. Changes only apply once you agree to them, for example at your next purchase. For credits already bought, the price and core terms at the time of purchase continue to apply.
14. Final provisions
(1) The laws of the Republic of Cyprus apply, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law only applies to the extent that it does not deprive you of the protection of mandatory provisions of the country where you have your habitual residence.
(2) If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Larnaca, Cyprus.
(3) If a provision is invalid, the other provisions remain valid.
